LIMITED LIFETIME WARRANTY Warranty. Strother Archery Inc., a Michigan corporation (“Strother”) warrants to the original end-user retail purchaser from an authorized Strother dealer that this product will be free from defects in material and workmanship and will substantially conform to the specifications and descriptions in the User Manual for the lifetime of the product after the date of original retail purchase, as supported by a dated receipt (the “Warranty Period”). This warranty gives you specific legal rights, and you may also have other rights which vary from state to state or from other jurisdiction to other jurisdiction. Some states or other jurisdictions do not allow limitations on how long an implied warranty lasts, so the above Warranty Period may not apply to you. Exclusions and Limitations. This warranty does not cover any failure of the product due to tampering, abuse, wear and tear in excess of that expected from normal consumer use, improper setup, failure to maintain as recommended, or exposure to moisture/heat. Improper or incorrectly performed maintenance or repair, commercial use, and/or alteration or removal of any serial number each will void this warranty. This warranty does not cover certain items included with the bow due to longevity of the material. These items include the strings/cables, cable slide, bearings, camouflage, paint finish, cable rod, grip and all vibration dampening included with bow. Remedies and How to Obtain Warranty Service. If the product is defective or fails to conform to the warranted specifications, Strother will repair and/or replace (at Strother’s option) the product. This is your exclusive remedy for defective or non-conforming products.
You must pay for shipping and any insurance to get the product to Strother at the applicable address. You assume all risk of loss and/or damage to the product until it arrives at Strother’s facility. Strother will pay for ground shipping of the new or repaired product back to you at an address in the applicable country or region and assume all risk of loss and/or damage to the product until it arrives at the address you specify. You must request, and pay for, any different shipping method. If Strother reasonably determines that the product has not failed to meet the standards of the warranty, you will be liable for the cost of return shipment to you, Strother may require payment of such costs before returning the product to you, and the risk of loss and/or damage will remain with you notwithstanding Strother’s possession of the product. If the product is not shipped through one of our authorized dealers, Strother Archery has the right to refuse shipment. Disclaimers and Other Provisions. EXCEPT AS SPECIFICALLY STATED IN THIS LIMITED WARRANTY AND EXCEPT FOR THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE TO THE EXTENT IMPOSED BY LAW, OR OTHER WARRANTIES THAT APPLICABLE LAW DOES NOT PERMIT TO BE DISCLAIMED STROTHER MAKES NO OTHER WARRANTIES AND DISCLAIMS ANY OTHER WARRANTIES, WHETHER EXPRESS OR IMPLIED. EXCEPT WHERE SUCH LIMITATION IS PROHIBITED BY LAW, IN NO CASE WILL STROTHER HAVE ANY LIABILITY FOR ANY INCIDENTAL, CONSEQUENTIAL, PUNITIVE, INDIRECT, OR OTHER DAMAGES, INCLUDING DAMAGES FOR LOSS OF USE, LOSS OF DIRECT OR INDIRECT PROFITS, OR LOSS OF OPPORTUNITY, EVEN IF IT IS AWARE OF THE POSSIBILITY OF SUCH DAMAGES. IN ANY CASE, STROTHER’S LIABILITY WILL BE LIMITED TO THE TOTAL AMOUNT ACTUALLY AND ORIGINALLY PAID AT RETAIL FOR THE PRODUCT. SOME STATES OR OTHER JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU. Each of these disclaimers is in addition to, and does not reduce the effect of, any other disclaimer. No dealer has the authority to change this warranty. No event that voids this warranty will have any effect on these disclaimers or limitations of liability. Applicable Law. Where not prohibited by the law of the jurisdiction in which the product is supplied to you, the law of the State of Michigan and of the United States of America will govern this limited warranty. |
